1. About these Terms
These Terms of Service govern your use of westicky — the website westicky.com, the web app at app.westicky.com and the public price pages it publishes (together, the "Service"). The Service is operated by westicky ("we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 16 years old to create an account. If you use the Service for a business, you confirm that you may accept these Terms on its behalf.
2. The Service
westicky lets service professionals keep one price list and turn it into a public web page, images for social media and messengers, QR codes and print-ready layouts. Features may change as the Service develops; we will not remove a paid feature during a period you have already paid for.
3. Your account
You sign up with an email and password or with Google or Telegram. Keep your sign-in details secure: you are responsible for activity under your account. Tell us at once if you believe it has been accessed without permission.
Provide accurate information and keep your contact details up to date. One account is for one person or business.
4. Plans
The Free plan is free of charge and has limits shown on the Pricing page. The Pro plan removes those limits and adds the features listed on the Pricing page and in the app.
Pro is sold for 30 days or for a year (365 days). Each payment buys one period; a new payment adds its period to the time remaining. Pro does not renew automatically and you are never charged without placing an order. When a period ends without a new payment, your account returns to the Free plan; your content and published page stay.
5. Payments and taxes
Our order process is conducted by NineLogix (NineLogix Global Commerce Limited), our online reseller and Merchant of Record. The Merchant of Record is the seller of the Pro plan: it accepts your payment, handles applicable transaction taxes (such as VAT or sales tax) as shown at checkout, issues receipts and handles billing questions, refunds and disputes.
Prices are in US dollars. The final amount, currency and any applicable tax are shown at checkout before you pay. Paid plans are available only where the Merchant of Record can accept payments and are not offered in countries and regions under sanctions.
We may change the price of Pro for future periods. A change never affects a period you have already paid for, and we will announce it in the Service in advance.
6. Refunds
Refunds are described in our Refund Policy, which forms part of these Terms.
7. Your content
You own what you add to the Service: your name, photos, services, prices and texts. You grant us a worldwide, non-exclusive, royalty-free licence to store, process and display it only as needed to run the Service — for example, to show your public page to its visitors and to draw your images.
Your public page and anything you export can be seen by anyone with the link. Do not publish information you do not want to share.
You confirm that you have the rights to everything you upload and that it does not break the law or anyone's rights.
8. Acceptable use
You agree not to use the Service to:
- offer illegal goods or services, or mislead clients about prices or services;
- publish content that is unlawful, hateful, sexually explicit, or infringes intellectual property or privacy;
- send spam or impersonate another person or business;
- attempt to break, overload or gain unauthorised access to the Service or other accounts;
- copy, resell or build a competing product from the Service or its templates.
We may remove content or suspend an account that breaks these rules. Where we can, we will tell you why first.
9. Our intellectual property
The Service, its design, templates, artwork and code belong to us or our licensors. You may use the images and files you export from the Service for your own business, including printing and publishing them. You may not extract or reuse the templates themselves outside the Service.
10. Availability and changes
We work to keep the Service available but do not guarantee that it will be uninterrupted or error-free. We may update the Service and these Terms. If a change to the Terms is material, we will notify you in the Service or by email before it takes effect; continuing to use the Service after that means you accept the updated Terms.
11. Ending your use
You can stop using the Service and delete your account at any time by writing to support. We may suspend or close an account that seriously or repeatedly breaks these Terms, or if required by law. If we close your account without a breach on your part, we will refund the unused part of a paid period.
12. Disclaimer and liability
The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all implied warranties, including fitness for a particular purpose.
To the extent permitted by law, we are not liable for indirect or consequential losses, such as lost profits or lost clients, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer under the mandatory law of your country of residence.
